In Missouri, only a few people have the right to file a wrongful death lawsuit on behalf of a deceased person. These people include:

Kansas allows an “heir at law” — or, someone who could stand to inherit from the decedent’s estate — to file a wrongful death suit. The state of Missouri has a three-year statute of limitations for wrongful death claims, while the state of Kansas has one of two years. Depending on where your loved one’s accident took place, you need to file a claim within two to three years of the date of your loved one’s death. If you do not, you lose the right to recover compensation.
